There is a common misconception amongst South African litigants that all legal costs will be recovered from an unsuccessful party, and more often than not, the costs of the matter exceed the quantum.
The court awards cost orders which will determine:

• If any costs can be recovered.
• If so, on which scale.

A process called 'taxation' will follow, where the taxing master reviews the bill based on tariffs, the court order, may ask for supporting documents, and has the discretion to disallow items.
