Description of the Approach, Methodology and Work Plan

APPROACH:

➢ At Albertus Johaardien Agulhas Incorporated we always keep our client’s goals and objectives in mind. We couple this with a strong imperative to keep costs under control while effectively taking action to resolve each dispute.

Our approach to the above considers the following:

Time:

➢ Adhering to time frames for resolution of disputes are crucial. In some cases, it might be optimal to simply settle matters and move forward, while in others the principle involved or the value of the dispute offsets any issue of “time.” We work to conclude our cases expeditiously while achieving the best possible outcome for our clients.

Control:

➢ Effective communication tools assist us in remaining in lock step with our clients throughout the process thereby keeping them in control of each decision along the way.

Cost:

➢ Cost containment is a primary focus of any dispute resolution strategy.

➢ The cost of resolving a dispute is directly associated with the time required and the level of control. The greater the power of the venue (Mediation, Arbitration or Court), the greater the amount of time we must invest to ensure that our assignments, evidence and filings are comprehensive and compelling.

METHODOLOGY:

➢ To maintain a high standard of quality, Albertus Johaardien Agulhas Incorporated is committed to process each case or enquiry through the following methodology to ensure strict control on quality and timely delivery:

Stage 1: Receiving Assignment:

➢ The process typically begins with a consultation to determine the nature of the dispute and a review of potential strategies that will assist in accomplishing the client’s goals.

Stage 2: Diagnose Problem:

➢ We diagnose the requirements of the client & the problems and/or obstacles. From an analysis of key elements, we identify the solutions and propose which way and how quick we can execute the service required.

Stage 3: Allocate Assignment:

➢ Assignments are distributed to different departments based on the nature of the case and forwarded to attorneys based on their special expertise. They are required to prepare the necessary study, set up the adequate strategy and determine the parameters to complete the assignment. The Lead Attorney is always responsible to keep the client informed and to review the Strategy employed from time to time to ensure an effective service is rendered.

Stage 4: Time Frame & Professional Fees:

➢ The parameters of the scope of work are then agreed upon and approved by the client along with anticipated time frames for the completion of assignment, the professional fees, mode of payment and the other terms and conditions involved.Stage 5: Implementation:

➢ We put all the necessary elements together, always applying legislative knowledge and appropriate measures to accomplish the diagnosed objectives and implement the agreed strategy.

Stage 6: Delivery

➢ The assignment is delivered according to pre-set priority schedules, based on client requirements.

Stage 7: Proactive Actions:

➢ Our work does not finish when one specific assignment is delivered. We add further value by executing our Proactive Monitoring Systems to detect possible legislative amendments, jurisprudence & administrative regulations.
