History:
Mr Cundell has been in legal practice and the employ of Richard Meaden & Associates since January 2008.Mr Cundell has acquired broad experience in Superior and Lower Court civil procedure and litigation, Customs and Excise procedures and disputes, arbitration process and construction disputes and criminal law. Mr Cundell has also specialized in contract drafting and corporate law.
Mr Cundell actively participates in the administration of Richard Meaden & Associates Inc and providing guidance and training to younger professional personnel.
Over and above this, Mr Cundell has also acquired unique exposure and experience regarding:
- Customs and Excise litigation, including Applications on Motion and Trials in rescission action, dispute resolution processes, including responses to Letters of Intent, Internal Administrative Appeals and withdrawal of Letters of Demand. Making representations to SARS Customs on behalf of clients, including Applications for Suspension of Payment. Obtaining release of detained and seized container consignments and in taking adverse decisions by authorities on successful review, including on the production of information and requests for reasons for decisions in terms of the Promotion of Administrative Justice Act.
- Operations of The South African Reserve Bank and the enforcement of Exchange Control criteria. In so doing, Mr Cundell has been exposed to the scope and operation of The Reserve Bank Act;
- Immovable property consolidation and Municipal Regulation procedures. Mr Cundell regularly engages with various local authorities and is exposed to applicable process.
- Assessment and formulation of construction related arbitration claims and building related disputes.
- Contract review, due diligence and risk assessment.
- Mr Cundell is also extensively involved in building construction and associated dispute / arbitration and litigation process and further has extensive experience in construction agreements which include JBCC Principal and Minor Works Agreements and Architect/Principal Agent Terms and Conditions.
- Structuring of Company and Shareholding instruments and company law compliance and dispute resolution.
- Mr Cundell has obtained advanced qualifications in drafting and interpretation of contracts and enjoys broad exposure concerning various contracts and contracting instructions received from clientele of Richard Meaden & Associates
Mr Cundell also acquired vast knowledge in respect of Customs and Excise matters. Mr Cundell was one of the instructing attorneys on behalf of Dragon Freight (Pty) Ltd & Others v The Commissioner of the South African Revenue Services & Others which resulted in a reported decision – Dragon Freight (Pty) Ltd & Others v The Commissioner of the South African Revenue Services (13585/20) [2020] ZAGPPHC 745; [2021] 1 All SA 883 (GP) (11 December 2020).
