Gugulethu Mthalane is a labour and employment law specialist with in-depth knowledge and experience in guiding employers through the complex procedures of correctly applying employment laws and due process fairly and responsibly, staying on the right side of the law and minimising risks of disputes and litigation.
She is currently an acting Judge of the Labour Court of South Africa and committee member of The South African Society for Labour Law (SASLAW).
Gugulethu is experienced in both unionised and non-unionised workplaces, and her practice extends from practical advice on resolving minor disputes to preparing for litigation and appearing on behalf of employers in the Labour Court and CCMA.
She has wide experience across all areas of employment law and the management of labour disputes and strike action, collective bargaining, restructuring and retrenchments, disciplinary and incapacity matters, and policy and employment contract issues including restraints of trade and confidentiality agreements. Gugulethu offers dispute resolution services as well as strategic advice to pre-empt disputes, and she is consulted by several private equity firms to assess and perform due diligence on employment-related risks in mergers and acquisitions.
Gugulethu provides regular updates to employers on developments in employment law, and facilitates training workshops on applying employment laws in the workplace.
